By downloading, installing, or using the Cruise in Ride mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App.

2. Eligibility

  • Maintain the security of your account credentials

4. Services Description

Cruise in Ride is a technology platform that connects:
  • Passengers seeking transportation services
  • Drivers providing transportation services using their own vehicles

4.1 Role of Cruise in Ride

We act as an intermediary technology platform only. We do not provide transportation services directly. We are not a transportation carrier, taxi service, or common carrier.

4.2 Independent Contractors

Drivers are independent contractors, not employees, agents, or representatives of Cruise in Ride. We do not control, supervise, or direct drivers' actions.

5. User Conduct

5.1 Prohibited Activities

You agree NOT to:
  • Use the App for any illegal purpose or in violation of any laws
  • Harass, abuse, threaten, or discriminate against other users
  • Provide false information or impersonate another person
  • Use the App while impaired by alcohol, drugs, or fatigue
  • Damage, disable, or interfere with the App's functionality
  • Attempt to gain unauthorized access to our systems
  • Resell, sublicense, or commercially exploit the App without authorization
  • Use the App to stalk, monitor, or harass any individual

5.2 Passenger Responsibilities

As a passenger, you agree to:
  • Be ready at the designated pickup location at the scheduled time
  • Treat drivers and their vehicles with respect
  • Pay all applicable fares and fees
  • Not smoke, consume alcohol, or use illegal substances in the vehicle
  • Not damage the driver's vehicle
  • Comply with all applicable seatbelt and safety laws

5.3 Driver Responsibilities

As a driver, you agree to:
  • Maintain a valid driver's license and vehicle registration
  • Maintain valid auto insurance meeting minimum state requirements
  • Ensure your vehicle is safe, clean, and well-maintained
  • Follow all traffic laws and regulations
  • Not discriminate against passengers based on protected characteristics
  • Not transport more passengers than your vehicle's legal capacity
  • Not use the App while under the influence of alcohol or drugs

6. Payments and Fees

6.1 Fare Calculation

Fares are calculated based on:
  • Base fare
  • Distance traveled
  • Time elapsed
  • Surge pricing during high-demand periods
  • Applicable taxes, tolls, and fees

6.2 Payment Processing

  • Passengers agree to pay all charges incurred through their use of the App
  • Payment is processed through third-party payment processors
  • You authorize us to charge your selected payment method
  • All payments are final and non-refundable unless otherwise stated

6.3 Promotions and Credits

We may offer promotional codes or credits at our discretion. These:
  • Are non-transferable
  • Cannot be redeemed for cash
  • May expire after a specified period
  • Cannot be combined with other offers unless stated

7. Cancellations

7.1 Passenger Cancellations

  • Cancellations made within a reasonable time may not incur charges
  • Cancellations after a driver has arrived or after a specified time may incur a cancellation fee
  • Repeated cancellations may result in account restrictions

7.2 Driver Cancellations

  • Drivers should only cancel rides in exceptional circumstances
  • Excessive cancellations by drivers may result in account review or deactivation

8. Ratings and Reviews

The App includes a rating system. You agree that:
  • Ratings must reflect genuine experiences
  • You will not manipulate or falsify ratings
  • You will not retaliate against users with negative ratings
  • We may remove ratings that violate these Terms

9. Intellectual Property

9.1 Our Intellectual Property

The App and its content, including but not limited to:
  • Software, code, and algorithms
  • Logos, trademarks, and brand elements
  • Graphics, designs, and user interfaces
  • Text, images, and multimedia content
are owned by or licensed to us and protected by intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

9.3 Restrictions

You may NOT:
  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices
  • Use our trademarks without written permission

10. Third-Party Services

The App may integrate with third-party services, including:
  • Apple Maps / Google Maps for navigation
  • Payment processors for transactions
  • Analytics providers for performance monitoring
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

11. Disclaimers

11.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

11.2 No Warranty

We do NOT warrant that:
  • The App will be uninterrupted, timely, secure, or error-free
  • The results from using the App will be accurate or reliable
  • Any errors in the App will be corrected
  • The App is free of viruses or harmful components

11.3 Transportation Disclaimer

We do NOT guarantee:
  • The safety, quality, or legality of transportation services
  • The accuracy of driver or passenger information
  • The suitability or insurance coverage of any vehicle
  • The conduct of any driver or passenger
YOU USE THE APP AND ANY TRANSPORTATION SERVICES AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:
  • We are NOT liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
  • We are NOT liable for any damages arising from:
    • Your use or inability to use the App
    • Any transportation services arranged through the App
    • Unauthorized access to your data
    • Third-party services or content

13. Indemnification

You agree to indemnify, defend, and hold harmless Cruise in Ride, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
  • Your violation of these Terms
  • Your use of the App
  • Your interaction with other users
  • Your violation of any third-party rights

14. Termination

14.1 By You

You may stop using the App and delete your account at any time.

14.2 By Us

We may suspend or terminate your account immediately, without notice, for:
  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Any reason at our sole discretion

14.3 Effect of Termination

Upon termination:
  • Your right to use the App ceases immediately
  • Any pending transactions may be cancelled
  • Provisions that by their nature should survive termination will survive

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

15.2 Dispute Resolution

Any dispute arising from these Terms shall be resolved through:
  1. Informal Negotiation: Contact us first to attempt resolution
  2. Binding Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration in Salt Lake County, Utah, under the rules of the American Arbitration Association
  3. Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions

15.3 Exceptions

Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property violations.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:
  • Posting the updated Terms in the App
  • Sending an email to your registered address
  • Displaying a notice upon App launch
Your continued use of the App after changes constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cruise in Ride regarding the App.

20. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, you acknowledge that:
  • These Terms are between you and Cruise in Ride, not Apple
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for addressing any claims related to the App
  • Apple is a third-party beneficiary of these Terms with the right to enforce them against you
BY USING CRUISE IN RIDE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
